Rep. Gutierrez Offers New Fix for 'Broken' U.S. Immigration System

Tired of waiting on Congress and the White House, Congressman Luis Gutierrez formally introduced his immigration-reform bill Tuesday.

Thousands of immigrants and their advocates went to Capitol Hill in October for a day of rallying, calling for comprehensive immigration reform.


There’s been a lot of talk thus far about immigration reform from lawmakers, advocates, and President Obama, yet no one has introduced a bill in Congress.

That changed as Rep. Luis Gutierrez, D-Ill., introduced a bill Tuesday called the "Comprehensive Immigration Reform for America's Security and Prosperity Act of 2009".

"We have waited patiently for a workable solution to our immigration crisis to be taken up by this Congress and our President," said Rep. Gutierrez. "This bill . . . is the product of months of collaboration with civil rights advocates, labor organizations, and members of Congress. It is an answer to too many years of pain —mothers separated from their children, workers exploited and undermined security at the border— all caused at the hands of a broken immigration system."

Gutierrez should have the support of the Congressional Hispanic Caucus, but experts say immigration reform legislation faces a tough time while the economy remains weak, jobs are scarce, and unemployment is over 10 percent.

"The Gutierrez proposal is an excellent beginning to devise legislation that will affirmatively fix America's dysfunctional immigration system and assist in the country's economic recovery,” said Nelson A. Castillo, a California immigration attorney.  “The success of the bill will depend on Congress' willingness to constructively debate these complex issues and spend the necessary political capital to move comprehensive immigration reform forward."

The Illinois Democrat was joined by a number of California Democrats, including Congressman Mike Honda, who heads the Asian-Pacific American Caucus and Congresswoman Lynn Wolsey, who heads the Progressive Caucus. Leaders in the Congressional Hispanic Caucus and Congressional Black Caucus also joined Gutierrez in unveiling the bill.

Activists have been pushing the Obama Administration and Congressional leaders all year to take up immigration reform and Gutierrez says “the time for waiting is over.”

Sarnata Reynolds, Advocacy and Policy Director for Refugee and Migrants' Rights at Amnesty International USA, says the timing could not be better. "Amid ongoing arrests and detentions resulting in egregious human rights violations for immigrants and refugees, U.S. Representative Luis Gutierrez (D-IL) today introduced CIR ASAP, a bill that recognizes the human rights of all in the United States and restores to immigrants and refugees important due process protections."

To become law, the immigration reform bill needs at least 218 votes in the House of Representatives and 60 in the Senate.

"I understand that the legislation would seek to include a rational and humane approach to the undocumented population, protect U.S. and immigrant workers, and enhance our nation's security and safety," said Castillo, a former President of the Hispanic National Bar Association.

While immigrant deportations have declined in recent years, the Census Bureau reports that there remain roughly 12 million undocumented workers in the United States. Finding a way to bring them legal status as well as workplace enforcement against those who exploit undocumented workers, has confounded Congress for years.

"The bill introduced today by Congressman Gutierrez and his colleagues would help create an immigration system that works for American workers," the United Food and Commercial Workers International Union said in a statement. "For too long, our nation’s immigration system has fueled exploitation, discrimination and abuse. It has allowed unscrupulous employers to drive down wages and working conditions in industries across the nation, while creating an underground economy where labor laws are shredded and workers are forced to toil in fear."

Rep. Gutierrez said he was submitting the bill before the holiday recess “so that there is no excuse for inaction in the New Year.”

US economy largely unaffected by illegal immigration Tucson, Arizona | Published: 12.03.2009 WASHINGTON — A study released Wednesday concludes that illegal-immigrant workers do not drain jobs or tax dollars and have a neutral impact on the U.S. economy. Because illegal immigrants occupy a small share of the work force — about 5 percent — and work low-skilled jobs at lower wages than other workers, their overall influence on the economy is trivial, according to the report, sponsored by the Migration Policy Institute, a pro-immigration think tank in Washington. "The fate of the U.S. economy does not rest on what we do on illegal immigration," said Gordon H. Hanson, author of the report and economics professor at the University of California-San Diego. Illegal immigrants contribute a tiny 0.03 percent of the U.S. gross domestic product, with that gain going to employers who save money on cheap labor, the report says, while their cost to the economy is 0.10 percent of GDP, which mainly comes from public education and publicly funded emergency health care. The net impact at minus 0.07 percent of GDP means that illegal immigrants have an essentially neutral effect on the economy, Hanson said. The report does not factor in the spending or entrepreneurship that illegal immigrants contribute to the economy, said Marc Rosenblum, senior policy analyst at the Migration Policy Institute. Where illegal immigrants do have a substantial impact, Hanson added, is in specific labor-intensive and low-skilled industries such as agriculture, construction, hospitality and cleaning services, where the share of native-born workers has dropped precipitously. Because the U.S. has dramatically raised the education level of its adult population in the last 50 years — going from about 50 percent of all working-age adults without a high school diploma in 1960 to just 8 percent today — the native-born, low-skilled work force has shrunk, while employers continue to require low-skilled workers. This leaves room for illegal immigrants to take such jobs at a low cost, the report says. Illegal immigrants now account for 20 percent of working-age adults in the U.S. who don't have a high school degree. While the influx of illegal immigrants is one of the factors keeping low-skilled wages stagnant, the biggest losers in the current system are legal low-wage workers, both native and foreign born, who compete with the illegal immigrants, Rosenblum said. Meanwhile, employers reap higher profits because of lower labor costs and more productive businesses. The solution to this imbalance, proposed by the Migration Policy Institute, is to provide more visas and legal channels for unskilled workers to enter the U.S. Today, low-skilled workers must have a green card — effectively requiring them to have close family members in the U.S. — or obtain a temporary work visa. "We really need to approach migration control comprehensively by both strengthening enforcements and creating legalization mechanisms that will control the unauthorized population and improve the economic outputs that we get from immigration," Rosenblum said.

Everyone must be warned before coming to the United States. Even if you have a visa, you are putting yourself at risk of Homeland Security ICE officers. I have a best friend that is from Paris France here on an education visa to finish his degree. He has been here since 2005. His visa is valid until March of 2010, His passport is valid until 2014, and his I-20 is current. He is not illegal. In 2008 He fell in love and married a U.S. citizen that just happens to be addicted to Prescription medications, He knew nothing about this. But he was arrested due to her mistakes. He was placed in detention, scheduled for deportation. He has been in detention center in Pompano Beach Florida for 5 months now. All this because of her mistakes. She should be the one in jail not him. Please everyone coming to America. Think twice. This couple has lost all there savings on lawyers, she lost her job, and they are in the process of losing there home. All this was caused because ICE has the wrong person in jail. They make up any story they want and when they are questioned about it you get nowhere. I have written many letters to Janet Napolitano, Senator Bill Nelson, and even President Obama. But no one will listen to the truth. So please people think twice about coming to America for any reason. Our immigration system is broken ….they all agree, but you put your life at risk when you enter our borders. Even if you follow the rules you may also lose everything as this couple has. No one will listen, no one cares. Not everyone ICE has in prison is illeagle, They have made a huge mistake. But no one will listen to me. this man has never even had a traffic ticket and is 51 yrs old. Shame on america

After permit expires employer never ask for another permit does not have valid driver liscense stil after 7 years person is working biggest pharmacy store Rite aid ,Costa Mesa ,CA People who went to school and has degrees and citizens don't have job eventhogh they are citizens.

We gave the illegal aliens amnesty back in 1986. At that time there were approximately 2 to three million illegal aliens. Now there are approximately 20 million. Wake up you bleeding heart left wing morons! Amnesty is a failure! Plus the fact that the illegal aliens in this country are being given all types of goodies in preference to OUR FELLOW AMERICANS who are out of work. Opposing illegal immigration has nothing to do with racism and everything to do with enforcing the IMMIGRATION LAWS OF THE UNITED STATES. Laws that have been ignored and flouted by crooked politicians, corrupt business owners and so forth. Try referring to the law abiding property owners of Arizona as racists! They are constantly under siege from illegal aliens and drug gangs from Mexico. The fools who make up the Congressional Hispanic Caucus have never denounced the violent acts of the Drug Cartel from Mexico, not to mention gangs like MS-13. Nope, we must enforce the existing laws.
