Nueva ética para Amador
Una iniciativa nacida en las aulas universitarias, y apoyada por una treintena de ejecutivos de grandes empresas, busca recuperar la confianza de la gente en los abogados mediante un sorpresivo giro: crear un compromiso de probidad que sea exigido desde la demanda.

No cuesta mucho trabajo darse cuenta de por qué son los propios abogados quienes quieren un cambio de imagen. Basta con entrar al portal web del diario El Comercio y escribir el nombre de esta profesión en el buscador para encontrar en un primer pantallazo los siguientes resultados:
“Abogado X se burla de la justicia”.
“Imagen que abogado quiso dar de Eva y Liliana se fue al piso”.
“Piden al abogado Z que se rectifique”.
Por supuesto, este problema es más profundo que la actuación irregular de algunos seudoprofesionales o la predilección de la prensa local por las noticias negativas. “Es cierto, el abogado no está bien visto, se piensa de él como aquel a quien se puede recurrir de cualquier modo. Es necesario cambiar esa visión”, dice Javier Durand, gerente jurídico de Cementos Pacasmayo.
Mucho de esto tiene que ver con el divorcio de confianza entre la opinión pública y una administración de justicia percibida como corrupta, que salpica desde al juez y al abogado de oficio hasta al más poderoso estudio legal del país. Pero el problema también está vinculado con la gran flexibilidad que tienen los abogados para cumplir el cuerpo de normas que rigen el ejercicio ético de su profesión, reglas cuya supervisión está en manos de los propios colegios profesionales.
En este escenario, una iniciativa surgida en las aulas de la Pontificia Universidad Católica en el año 2006, propone dar una vuelta de tuerca a la situación. “La propuesta asume que cumplir con el marco normativo es también un compromiso de los privados”, explica Beatriz Boza, la principal impulsora del proyecto. En suma, se trata de crear un sistema de control de conductas éticas que el abogado quiera –y no solo deba– cumplir porque la presión vendrá desde la demanda.
¿Cómo se espera que funcione? Convirtiendo las normas de conducta del abogado en parte de las políticas corporativas del sector privado, lo que hará que las empresas exijan a sus proveedores de servicios legales cumplir estos códigos. De no estar interesados, los estudios y bufetes perderían a sus clientes más grandes. Y esa es una situación a la que casi ningún abogado quisiera llegar.
La propuesta ha recibido una cálida recepción en ejecutivos de importantes empresas locales, profesores universitarios y miembros de grandes estudios de abogados. Pero también ha sido vista con frialdad por algunos sectores del ejercicio profesional. Aunque el debate recién empieza, el escenario parece dispuesto para un intenso pulseo durante los próximos meses.
Las cuatro patas de la mesa. La propuesta integral, que ha sido llamada “Sistema de Control Ético de los Abogados”, comprende cuatro líneas de acción que están en distintas etapas de avance. La primera tiene como meta lograr que los gremios y las principales empresas del país asuman un compromiso para hacer del proyecto parte de sus políticas de responsabilidad corporativa. Dos semanas atrás, Beatriz Boza y el grupo de estudio de la iniciativa se reunieron con la dirigencia de la Confiep, liderada por Ricardo Briceño, quien mostró buena disposición para tomar el encargo (vea nuestra entrevista a Briceño en esta edición).
Personalidades como Jorge Avendaño, catedrático y socio del Estudio Avendaño; Javier de Belaunde, del Estudio Echecopar; Alfredo Bullard, del Estudio Bullard y Falla; Enrique Felices, de Miranda y Amado; Mario Pasco, del Estudio Delfino y Pasco; José Ugaz, del Estudio Benítez Forno & Ugaz; y Walter Albán, decano de la Facultad de Derecho y gestor de la iniciativa, entre otros, dieron una revisión inicial a la propuesta de normas de conducta y responsabilidad.
Treinta y un gerentes jurídicos de grandes empresas como Telefónica del Perú (TdP), Backus, Minera Yanacocha, BCP, Interbank, Ferreyros, Scotiabank, Graña y Montero, y Southern, entre otras, han participado de la iniciativa, a título personal pero con el respaldo de sus instituciones. Ellos han analizado los textos para dar una opinión desde su óptica de abogados, pero, al mismo tiempo, de clientes que contratan servicios profesionales externos en sus compañías.
Hay varios motivos para explicar el involucramiento de estos ejecutivos en el proyecto, pero dos son los más importantes. “Indudablemente, esta visión del ejercicio ético del derecho forma parte de nuestro comportamiento profesional y de la cultura corporativa de nuestras empresas”, dicen Julia María Morales, secretaria general de TdP, y Francisco Rivadeneira, vicepresidente de asesoría legal de Scotiabank.
Pero también, añaden, no cumplir con prácticas responsables puede acarrear con el tiempo consecuencias económicas muy grandes. El simple hecho de estar involucrado en un escándalo es ya, para las empresas, un gran pasivo, una carga reputacional.
Las siguientes dos líneas de acción están en una etapa más avanzada. En julio de este año, se publicó en la intranet de la PUCP, para consulta pública, la propuesta de Normas de conducta y responsabilidad del profesional en Derecho, el documento que resultó de las múltiples revisiones mencionadas líneas atrás. “Estamos en un 90% de avance, siempre puede ser perfeccionado”, dice Boza.
Este manual de normas, a diferencia de los códigos de ética de los colegios profesionales, no solo incluye principios fundamentales de la práctica del abogado (del tipo “tener como fines primordiales la defensa de la justicia y el Estado de Derecho”), sino que “aterriza” en situaciones concretas, aquellas que ocurren a diario en el ejercicio de la profesión.
Hay, por ejemplo, un capítulo entero sobre el tema de la lealtad profesional, cómo evitar el conflicto de intereses, cómo se ejecuta el patrocinio debido y cómo deberían manejarse las relaciones entre colegas, entre cliente y profesional, las fuentes y los testigos, etc. Se define la responsabilidad solidaria de los socios de un estudio por el accionar de sus colegas y se incluye la posibilidad de absolver consultas profesionales en medios de comunicación, una práctica usual pero no normada en los códigos vigentes.
Son 112 artículos relacionados con la práctica y 30 más que contemplan mecanismos de disciplina y sanción. Esta parte del cuerpo, la relacionada con la previsión y las penas a los infractores, es la tercera línea de acción.
El último ángulo es el más delicado y el que aún está en etapa de diseño. Se trata de crear un cuerpo que se encargue de vigilar el funcionamiento de la estructura descrita. Una especie de ente supervisor, que observe las situaciones de conflicto, las siga y decida. Esta etapa empezaría a trabajarse en el primer semestre del 2010.
“Es jurásico”. Dos palabras describen, para un abogado limeño, el cuerpo de normas contenido en el Código de Ética del Colegio de Abogados de Lima (CAL), la orden profesional más grande del país. Este documento, aprobado hace apenas 12 años, contempla en sus 48 artículos un conjunto de reglas de tipo aspiracional, que hablan de ser un buen servidor de la justicia y de mantener el honor y la dignidad. Pero tiene dos problemas: permite una interpretación laxa de cada punto porque no “aterriza” en situaciones concretas, y está desactualizado.
Diversos abogados consultados para este artículo señalaron las debilidades de dicho texto. La más comentada es la llamada “generación de clientela”, un punto que contempla los mecanismos por los cuales el abogado puede generar de manera honrosa sus propios clientes. El Código de Ética del CAL acepta “la publicación y el reparto de tarjetas meramente enunciativas del nombre, domicilio y especialidad”. Pero considera la publicidad directa o indirecta con fines de lucro “un menoscabo de la dignidad profesional”.
